DOLE issues pay guidelines for National Heroes and Ninoy Aquino holidays

DOLE reminds employers and business owners of the proper pay guidelines for those employees who work on holidays.

The Department of Labor and Employment (DOLE) reminded employers and business owners to observe proper pay rules for their employees who worked on August 21 and this coming August 29.

August 21 was declared as a special non-working holiday or the “Ninoy Aquino Day” while August 29 is a regular holiday known as the “National Heroes Day”

Workers who reported on Sunday, August 21 should get the correct payment of overtime pay, especially in the case of working on a holiday, the Manila Bulletin quoted DOLE’s advisory.

The same could be said for workers who will report on August 29.

The "no work, no pay" policy shall be in effect unless there is a company policy, practice, or collective bargaining agreement (CBA) granting payment on a certain day, in accordance with Proclamation No. 1236 issued by President Duterte back in 2021.

“Work performed on a special non-working holiday merits additional compensation of at least 30 percent of the basic wage or a total of 130 percent,” DOLE’s advisory says.

DOLE’s advisory also said that when work is done during a special non-working day that also falls on the employee's rest day, this shall entitle the employee to an additional compensation of at least 50 percent of the basic wage or a total of 150 percent.
