In a recent panel discussion featuring the Philippines' top industry leaders, GCash Chief Compliance Officer, Atty. Cef Sison, highlighted the potential of updating the Anti-Money Laundering Law (AMLA) to fortify existing legislation against online child exploitation. At the core of her argument is the belief that the evolving landscape of cyber threats demands a more adaptive and robust regulatory framework to safeguard the youth.

The legislative backbone in question is Republic Act 11930, the 'Anti-OSAEC and Anti-CSAEM Act,' spearheaded by women empowerment advocate Senator Risa Hontiveros. Atty. Sison contends that while RA 11930 is a potent tool in combating online sexual abuse and the dissemination of exploitative materials involving children, synergizing it with AMLA updates can create a formidable defense against the perpetrators.


Under RA 11930, entities like GCash are obligated to promptly report any instances of online sexual abuse or exploitation of children on their platform to the Department of Justice (DOJ) and the Anti-Money Laundering Council (AMLC). Furthermore, the law mandates cooperation with judicial orders, reinforcing its commitment to the swift and effective eradication of such heinous activities.


Atty. Sison delves into the technical realm, expressing the inadequacy of traditional AML parameters in keeping pace with the rapidly evolving landscape of online transactions. To address this, GCash is exploring the integration of generative artificial intelligence, recognizing the need to combat increasingly creative perpetrators who may be utilizing AI for malicious activities.


In a call for action, Sison emphasizes the necessity of processing individuals with generative AI to match the speed and volume of new users and transactions. This move is crucial to staying one step ahead of perpetrators who exploit the vulnerabilities of the digital space for their illicit gains.


The GCash chief compliance officer also raises concerns about perpetrators misusing the right to data privacy. She argues that the principles of law should override this right when the safety of innocent individuals, particularly children, is under threat. This assertion reflects a balanced approach, recognizing the importance of privacy rights while prioritizing the protection of society's most vulnerable members.


GCash's commitment to the cause was underscored by its participation in the Anti-Online Sexual Abuse and Exploitation of Children Conference, where collaboration with key stakeholders, including Senator Risa Hontiveros and Quezon City Mayor Joy Belmonte, reinforced the shared mission of ensuring the safety and security of all citizens.
